Newport Beach, CA, Attorney Handles Complex Divorce Matters

Reaching a fair outcome in challenging dissolution cases

Since Silverman Family Law, APC, in 1993, the firm has earned a reputation for successfully resolving complex divorce matters. I have knowledge about and uses alternative dispute resolution (ADR) techniques and exercises skills in managing emotional dynamics. I can, and do, negotiate settlements in many challenging and fiercely disputed divorces. On the other hand, I am a zealous advocate for my clients in litigation when trial can lead to a better result.

Mental-health and psychological issues leading to high-conflict divorce?

If not effectively addressed, your spouse’s or partner’s psychological issues could create volatile conditions that may thwart your efforts to successfully complete your dissolution and impede you or your Family Court in moving on with life. Such severe issues as mental illness, substance abuse, domestic violence and parental interference often make negotiation impossible, thereby hampering the process of dissolution litigation and adding stress to an already challenging experience. I apply my psychology credentials and 15 years of counseling experience to address these destructive problems head on.

Contested child custody and/or visitation matters

Often, one of the most emotional aspects of dissolution is child custody and visitation. With your parental relationship at stake, child custody matters can be hostile and contentious. I take decisive steps to protect your parental rights and to effectively address high-conflict custody issues. I diligently gather evidence proving what is in the best interests of your children — the primary consideration of the family law court when making child custody or visitation decisions. For example, if your spouse threatened to relocate with your child, I demonstrate the benefits of your child remaining near you and the detriments associated with the proposed move.

Disputes regarding division of marital property

Each spouse may calculate vastly different amounts regarding the value of the marital assets. Opposing parties may not even agree about whether certain items are marital property or the property of an individual spouse. I maintain professional relationships with experts in real estate, stocks, finances, securities and rare objects who advise us and/or our client about asset valuation. I meticulously back up my numbers with proof of your interests in the property and written appraisals from these reputable experts. A dispute about the validity of your premarital agreement can complicate the division of martial assets, often with one spouse contending that the terms of your agreement are enforceable and the other spouse not agreeing, alleging misrepresentation, fraud, duress, coercion or inadequate representation.
