Newport Beach CA Collaborative Marital or Partnership Dissolution Attorney Reach Equitable Resolutions

Guiding clients toward just settlements in Orange County

Mediation or private judging are alternative routes for resolving dissolution and the associated issues, allowing a couple to reach an agreement in a private, calm, cooperative and nonadversarial environment. Mediation has the added benefit of being confidential. Both parties and their attorneys commit to a cooperative and efficient settlement process.

Established in 1993, Silverman Family Law, APC, concentrates exclusively on Family Court-law issues. My goal is to obtain the best possible terms in your divorce in the most efficient and least stressful manner. If it is right for your circumstances, I recommend the nontraditional and alternative methods for reaching a resolution on any or all issues in the dissolution, including the final settlement.

My commitment to the collaborative law process

I studied and am practiced in mediation and collaborative methods, including advanced training in collaboration, and obtained extensive mediation and dispute-resolution education at Pepperdine University School of Law, Strauss Institute for Dispute Resolution in Malibu, CA. Because I also act as a Family Court-law mediator, I am practiced and skilled in finding common ground and encouraging separating couples to cooperate in reaching an agreement. In addition, I hold a Ph.D. in psychology and enjoyed a 15-year career as a marriage and Family Court and child counselor and child psychologist before attending law school. During my 20+ years of Family Court-law practice, I experienced the advantages of this collaborative method with my clients and am committed to engaging in this effective model when they can benefit by:

  • Reducing costs of the divorce
  • Finalizing the divorce more efficiently
  • Creating a more amicable, diplomatic environment
  • Taking control over the decision-making process
  • Being committed to cooperation when children are involved
  • Reaching an agreement about dividing marital assets that is fair and acceptable to both spouses

The collaborative process

During your collaborative divorce, both parties and their attorneys cooperate to devise equitable settlement terms that are in your children’s best interests and are fair to both parties. The parties’ teams disclose information, share documents with each other and engage in open discussions geared toward reaching a mutually beneficial agreement. If evaluations or assessments are necessary, an agreement is made to retain neutral experts to provide impartial evaluations of the issues. You may also receive assistance from coaches who can help you cope with the anxiety related to child custody and visitation matters. This process does not include appearing in a courtroom, unless, at least, one party chooses to switch to standard litigation.
